WHY DO YOU NEED A LIEN SEARCH?
All Liens are not required to be recorded and will not show up on a title search. The new owner will be under the impression that their new purchase is free and clear when in reality they are in jeopardy of inheriting various liens, as well as outstanding permits and code violations, which are not covered by the Buyers Title Insurance policy.
Estoppels consist of current financial and non-financial information from the Homeowners Association; this information is required by lenders and title companies and is a stipulation of closing. An Estoppel entails information such as buyer approval requirements, recreational/ land leases, violations against the association bylaws, maintenance fees, special assessments and/or any fees that may be outstanding. If the property is delinquent in the HOA Maintenance Fees, we obtain the payoff from the attorney which will outline the fees owed. We also provide supporting documentation such as ledgers and/or fee breakdowns along with an IRS W-9 form so that payments of association dues may be properly reported.
